Chennai, April 13, 2026 — Actor-turned-politician and Tamilaga Vettri Kazhagam (TVK) chief Thalapathy Vijay (C. Joseph Vijay) has filed a writ appeal before a Division Bench of the Madras High Court, challenging a single-judge order that upheld a ₹1.5 crore penalty imposed by the Income Tax Department.
The development comes just over two months after Justice Senthilkumar Ramamoorthy dismissed Vijay's writ petition on February 6, 2026. The single judge ruled that the penalty order was issued within the limitation period prescribed under Section 275(1)(a) of the Income Tax Act, 1961, and found no grounds for judicial interference on that basis. However, the court explicitly left open the option for Vijay to challenge the penalty before the appellate authority on other grounds.
# Background of the Case
The penalty stems from a search and seizure operation conducted by the Income Tax Department on September 30, 2015. Authorities alleged that Vijay failed to voluntarily disclose an additional ₹15 crore in income for the financial year 2015-16, related to his film Puli. Vijay had declared ₹35.42 crore in his ITR for that year, but the department treated the undisclosed portion as concealed income.
The department subsequently imposed the ₹1.5 crore penalty under Sections 271(1)(c) and 271AAB(1) of the Income Tax Act. Vijay challenged the penalty (specifically under Section 271AAB(1)) via a writ petition in 2022, arguing primarily on grounds of delay in issuing the notice. An interim stay on recovery had been in place since then.
Vijay had earlier appealed the assessment order and a related penalty under Section 271(1)(c) through statutory channels, securing partial relief at the Commissioner of Income Tax (Appeals) level. The matter also saw proceedings before the Income Tax Appellate Tribunal (ITAT).
# Latest Appeal
In the fresh writ appeal filed against the single-judge's February 6 order, Vijay is contesting the dismissal and seeking to set aside the penalty. The appeal focuses on the single judge having rejected the plea solely on the limitation issue without addressing other contentions raised by the petitioner.
Legal experts note that while the single-judge bench upheld the department's position on the timeline of the penalty order, the door remains open for further challenges on merits at the ITAT or through this division bench appeal.
# Political Context
The case has drawn significant attention as Vijay, a popular Tamil film star known as Thalapathy, transitions into active politics with TVK. The ruling and subsequent appeal come ahead of the 2026 Tamil Nadu Assembly elections, with some political observers suggesting it could be used by rivals to question his transparency. Vijay's team has maintained that he has complied with tax obligations and is pursuing all legal remedies available.
This is not the only legal hurdle for Vijay and his upcoming film Jana Nayagan, which has faced separate censor and release-related challenges in recent months.
As of now, the Madras High Court has issued notice in the writ appeal. The matter is expected to be listed soon for further hearing. Vijay's legal team has not issued a detailed public statement on the appeal, but sources indicate they remain confident in their position on the merits of the case.
The Income Tax Department has so far declined to comment on the ongoing proceedings.
